Terms of service

These terms are the agreement between you and Jeric Guillermo, trading as VisitorLoop for using VisitorLoop. By creating an account you accept them. If you use VisitorLoop for a company, you accept them for that company.

What VisitorLoop is

VisitorLoop puts widgets on your website (banners, popups, messages, social proof, tooltips, embedded forms and live chat) from one script, keeps the contacts they collect, and sends the emails you set up. It's run by Jeric Guillermo, trading as VisitorLoop. Contact: [email protected].

Early access, and what it costs

VisitorLoop is in early access: it's free, with a fair-use limit of 500 emails a day to your contacts per account. It's also still changing: features can change, and we can't promise it's always available. When paid plans come, we'll tell you at least 30 days before; nothing is charged unless you choose a paid plan.

Your account

  • Keep your login safe; you're responsible for what happens in your account. Tell us at once if you think someone else got in.
  • The information you give us must be true, including your email address, which you confirm before VisitorLoop sends emails for you.
  • You must be old enough to agree to these terms where you live, and at least 16.

Your visitors and contacts

For the people who visit your website and fill in your forms, chat with you, or get your emails, youare responsible (under the GDPR, you're the controller and we process their data for you). That means you:

  • tell your visitors about VisitorLoop in your privacy notice, and ask for consent where the law requires it (for example for cookies, or for marketing emails);
  • email only people who agreed to hear from you, or are your customers where the law allows that, and honour every unsubscribe (VisitorLoop adds the unsubscribe link and keeps the list);
  • include what the law asks of your emails, like who you are and your postal address;
  • don't collect special categories of data (health, religion and the like), payment card numbers or passwords through your forms.

We process your visitors' data only to provide VisitorLoop to you, as described in our privacy notice, which also lists who helps us run it. These terms, with that notice, are the data processing agreement between us.

What you may not do

  • Send spam: unsolicited email, or email to bought, rented or scraped lists.
  • Pretend to be someone else, or use VisitorLoop for phishing, fraud, malware, or anything illegal.
  • Show visitors false information: fake reviews, made-up purchase alerts, false scarcity or countdowns.
  • Overload, probe or break VisitorLoop, or get around its limits.

We can limit or close an account that breaks these rules, straight away when that's needed to protect others (for example to stop spam), and we'll tell you why.

Your content

What you put into VisitorLoop (your widgets, emails, contacts, chats) stays yours. You give us the right to store, process and show it as far as needed to run VisitorLoop for you. You can export or delete it, and it's deleted when your account is.

Liability

VisitorLoop is provided as it is, especially during early access. As far as the law allows, we're not liable for indirect or consequential loss (lost profit, lost data, lost business), and our total liability is limited to what you paid us in the 12 months before the claim (during early access, that's nothing). Nothing here limits liability that the law doesn't allow to be limited.

Ending

You can stop using VisitorLoop and ask us to delete your account at any time. We can end these terms with 30 days' notice, or straight away for a serious breach. When an account ends, we delete its data within 30 days, except what the law makes us keep.

Changes and law

We may change these terms; for important changes we email you at least 30 days ahead. These terms follow the law of the Philippines, and its courts decide disputes, without taking away the protection the law of your country gives you as a consumer.
